Terms and Conditions

Access: Fossey Fund grants you a personal, non-exclusive, non-transferable, limited license to use the Site solely for your personal or internal use and subject to the condition that you do not (and do not allow any third party to) copy, modify, create a derivative work from, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in, or otherwise transfer any right in or access to the Site or any content available via the Site. You further agree not to modify the Site, or any part thereof, in any form or manner, nor to use any modified versions of the Site, for any reason whatsoever, without the express written consent of Fossey Fund.  You may not attempt to gain any unauthorized access to the Site or any of its associated content, including computer systems, software, or networks.  No commercial use or redistribution of any content, materials, or information contained on or offered through the Site is permitted, unless expressly specified in a prior agreement between you and Fossey Fund.

Use: You agree not to use the Site to:

• Upload, post, email, transmit, or otherwise make available any material or content:
• that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, false or inaccurate, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable;
• that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary information, and confidential information, learned or disclosed as part of employment relationships or under nondisclosure agreements);
• that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party; or
• that may be deemed to be lobbying or electioneering communications within the meaning of applicable federal law;
• Harm minors in any way;
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
• Post any unsolicited or unauthorized advertising, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes”, or any other form of solicitation;
• Post any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
• Interfere with or disrupt the Site or servers or networks connected to the site, or disobey any requirements, procedures, policies, or regulations of networks connected to the Site.
• Launch any automated system, including without limitation, “robots”, “spiders”, “scrapers” or “offline readers” that accesses the Site in a manner that sends more request messages to the Site’s servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser;
• Notwithstanding the foregoing, Fossey Fund grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. Fossey Fund reserves the right to revoke these exceptions either generally or in specific cases.
• Violate any applicable local, state, national, or international law, intentionally or unintentionally;
• Stalk or otherwise harass another person; and/or
• Collect or store personal data about users.

Fossey Fund reserves the right to take whatever lawful actions it may deem appropriate in response to actual or suspected violations of the foregoing, including, without limitation, the suspension or termination of a user’s access to the Site. Fossey Fund may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong and except as may be expressly limited by the Privacy Policy, Fossey Fund reserves the right at all times to disclose any information as Fossey Fund deems necessary to satisfy any applicable law, regulation, legal process or governmental request. You also agree to reimburse Fossey Fund for any damage, loss, cost or expense Fossey Fund incurs (including fees or costs of attorneys, accountants, professional advisors, and other experts incurred in connection with the defense or settlement of the foregoing) because of your use of the Site for any unlawful or prohibited purpose.
